The Contract


The Town House

  • Nothing must be stuck to the walls or furniture - no tape, blu tack or pins.  Or to the front of the house.
  • The balcony is only to be used as a fire escape.  Sadly due to previous guests causing noise disturbances to the local residents, the balcony area is only to be used as a fire exit.  Please keep noise levels to an absolute minimum being mindful of our neighbours and guests in the basement flat.
  • No standing or jumping on furniture, including beds and sofas.
  • No loud music
  • Please keep the front and back door closed at all times when inside the house and no congregating outside the front or back of the property.
I am afraid that we do not accept all male groups/stag parties at The Town House.

The Post House

N.B.

  • No disturbances outside - please keep mindful of our neighbours.
  • No BBQs
  • Please supervise children at all times.

With reference to parking at The Post House

Please use the drive at the back of the house.  There is space for 4 x medium cars.

If you have more than 4 cars, there is a lay-by/parking area approx 150 metres up the road on the same side as The Post House.  

Please do not be tempted to park on the pavement outside the front of the house.  This is highly forbidden.  It makes the road incredibly dangerous.  There is a lay-by opposite the house, but this is the only place for my neighbours to park and so we do ask for our guests not to park there please. 
The Properties (The Post House, The Town House and The Secret Escape) may be occupied only for short term holiday letting with no rights of occupancy beyond the contracted dates. The Contract for the rental of the Properties is between you (the "Tenant") and K N Price (the "Owner"). You shall be jointly and severally liable with the others in your party and all those in your party shall be bound by the terms of the contract herein. You shall be responsible for any minors in your party.

A contract is not made until a booking request has been confirmed by the Owner and a cleared deposit payment has been received by the Owner or Credit card details are given. The Contract shall be governed by English law. If any provision within the Contract is found to be legally invalid or unenforceable, such provision shall be deemed not to form part of the Contract but the other provisions of the Contract shall not be affected.

The Owner has taken care to describe the Properties accurately on internet websites and elsewhere. The Properties may be subject to minor changes and the Tenant accepts that there may be minor differences from the descriptions. Rental charges include central heating and hot water, electricity, Wi-Fi, all bedroom and kitchen linen and towels.

You can book by email to [email protected], or by telephone (01761 241704 or 07767 202295). Please remember that your booking is secured when you have received confirmation of acceptance and the appropriate payment has been received.

Payment Arrangements

For bookings made more than 8 weeks prior to your rental dates, a deposit of one half of the rental sum should be made at the time of booking. For bookings made within 8 weeks of your rental dates, full payment should be made at the time of booking. Where a deposit has been paid, the balance is payable not later than 8 weeks prior to rental dates.

The Owners may cancel a booking and retain any deposit payment if payments are not received by the due dates. 

Payment may be made by credit or debit card. 

Credit Card Pre-Authorisation

We operate a pre-authorisation system for a £500 Security Deposit.  We hold the sum of £500 on your card.  This is held a day prior to your arrival, and released within a week of your departure.  As part of your contract with us, you agree to being charged for any replacements, repairs or supplementary cleaning for which you can reasonably be held liable.  You also agree to being charged if you or any of your group cause a noise disturbance or break any of the terms mentioned above.

Cancellation

In the unhappy event that you must cancel your Booking (*Please see below for Christmas and New Year bookings) after you have paid your deposit or your full balance, we will make every effort to rebook the property. If the property is rebooked, your funds will be returned, less a £100 Administration Fee.  If it is not rebooked, we do not offer a refund.

* For bookings made for the Christmas/New Year period (22/12 - 3/1), in the unhappy event that you must cancel your booking after you have paid your deposit or your full balance, all payments are non refundable.

If, for any reason, you need to cancel your confirmed booking, you should do so in writing by email to  [email protected]  or by post to Karen Price, The Post House, Bathway, Chewton Mendip Somerset, BA3 4NS.

The Properties or Property

The Properties are to be used for normal holiday occupation only. The Properties may not be sublet or used as a party or reception venue. The Post House may only be used to accommodate up to 12 guests, The Town House, 10 guests, or in case of The Secret Escape up to 2 people. The Owners may enter the Properties at any reasonable time, or, if for an emergency, immediately.  BBQ's are not permitted.

Owners' Obligations

The Owners will make the Properties or Property available to the Tenant for the agreed rental period. The Owners will ensure that the Properties are clean and tidy, in good condition for the Tenant. The Owners will endeavour to repair or replace any essential item of equipment should it fail during the rental period, except if such failure is due to negligence or wilful damage by the Tenant.

The Owners will address any complaint raised by the Tenant promptly and seek a satisfactory resolution where possible. The Tenant is asked to raise any problems with the Owner in good time so that the Owner can take effective measures to resolve any such problems. Complaints that remain unresolved should be notified in writing to the Owners, who will resolve the complaint or respond in writing.

Tenant's Obligations


The Tenant must confirm the total number of guests staying in the property, at the time of booking.

The properties must not be used as a centre for external party goers i.e. tenant's do not have the right to invite numerous guests who are not already registered as staying.

The Tenant will not cause a nuisance, disruption or annoyance to the neighbours or others.

PLEASE NOTE: You are responsible for the condition of the property when you depart.  It is important that everyone in the party is aware of this point.  We ask you kindly to respect our Properties as we have put heart and soul into making them special places for everyone to enjoy. We have also spent much time in collecting the individual pieces of furniture, and ask you to treat them as if they were your own.

We are located within desirable areas and have lovely neighbours, whom we ask you to respect with regard to noise levels.  Please do not play loud music at any time, and if we are made aware of disturbances, after 10pm, including raised voices, we reserve the right to retain the whole of your damage deposit.  We apologise, if this sounds harsh, but our business depends upon a good relationship with our neighbours.

All Properties are totally non smoking house. The Tenant will comply with reasonable rules or requests of the Owners. Any damage or breakages should be reported to the Owners immediately so that replacement or repair can be effected without delay. The Tenant agrees to pay to the Owners such reasonable costs as may be necessary to repair or replace anything lost or damaged during the Tenant's period of occupation. The Tenant agrees to use the equipment, fixtures and fittings with due care and in accordance with instructions given. The Tenant agrees to abide by any safety advice given by the Owners.

Cleaning

Your rental payment includes normal ‘turnaround’ cleaning which takes 4 - 5 hours. This includes changing the beds, vacuuming, cleaning bathrooms and dusting. It does not include ovens, grills, taking out rubbish and doing the washing up. If you would like to arrange for extra professional cleaning on your departure day or during your stay, you should notify the Owners in advance of your arrival or immediately upon arrival.   Any stains or soiling that cannot be effectively removed will be treated as damage and charged for.

Animals

Dogs are permitted.  Strict rules apply.  Dogs must not be left alone in the house unless they are kept in their own cage.  They are not permitted upstairs or on the furniture.  One dog is included in the price.  Further dogs are £20 per dog per night.

Limitation of Owners' Liability

Except in cases of death or serious injury caused by the Owners' negligence, or for any liability that by law cannot be excluded, any Owners' liability to the Tenant for breach of contract, misrepresentation or other cause will be limited to a sum not exceeding twice the total amount of rental payment received from the Tenant.

The Owners shall not be liable where performance of the contract is delayed, changed or cancelled for reasons beyond the reasonable control of the Owners. 

Data Protection

The Tenant agrees with the Owner that the Owner may store such personal data as may be supplied by the Tenant and that, unless otherwise notified by the tenant, such information may be used for keeping the Tenant informed or for marketing purposes. No information supplied by the Tenant will be passed to third parties except as far as it is necessary to do so for the purposes of fulfilling the Tenant's contract with the Owners (for example, for processing payment, obtaining insurance).

Credit/debit card details will only be stored by the Owners as far as necessary for the purposes of taking legitimate payment in relation to the Tenant's occupation of the Property and reimbursement for damage caused by the Tenant.

Arrival and Departure Times

We prefer our guests to arrive between 1600hrs and 1930hrs. Other arrival times can be arranged by prior agreement, so please contact us if you have special requirements. We require guests to check out by 1030hrs on their departure date.

Smoking

Please note that all Properties are non-smoking throughout.
